Preamble

These general terms and conditions of sale (hereinafter referred to as the "GTCS") apply to any order for online training, strategy scripts, other goods or services placed on the www.trading-bot.fr website (SIREN: 511 141 806) (hereinafter the "Site"), by any customer who is an individual of legal age (hereinafter the "Customer").

Article 1 - Purpose

The purpose of the GTC is to define the rights and obligations of the parties in connection with the sale of online training courses by Trading-Bot.fr to the Customer.

Article 2 - Enforceability of the GCS

The General Terms and Conditions of Sale apply to the Customer's first order on the Site. The customer declares that he/she has read the GTC before his/her first order and accepts them unreservedly. The GCS can be consulted at any time on the Site.

Article 3.1 - Description of subscriptions, training courses and digital content

The training courses offered on the Site are online learning programs designed to enable the Customer to acquire knowledge and skills in the field of trading. They can be sold alone or with trading strategy scripts, as a fixed purchase, for life or as a subscription. Training courses are provided in digital form (all files) on the website. The updating of training courses / contents / settings list is not guaranteed, but the Customer will have free access to all updates of the various contents made during the active period of his training course (3 months maximum from registration). 

Trading-Bot.fr offers paid access to its flagship TopBot Anomaly Robot Strategy in its Pro version, available on demand on the external TradingView platform. Once the appropriate subscription has been taken out, customer-specific access is opened by the team within 72 hours, using the TradingView ID entered by the customer when registering. Access to TradingView is then guaranteed throughout the active subscription period, subject to availability of the external TradingView site. 

Article 3.2 - Access to training

Access to training courses is reserved for customers who have created an account on the Site and subscribed to a free or paid subscription. Access is unlimited in time, subject to modification of the site and content. 

Article 3.3 - Refunds

Trading-Bot offers free access to all training courses and to a LITE version of its strategy on TradingView, so that customers can get a feel for the product and the offer. Subscription refunds are generally not possible, except in special cases and at the discretion of the Trading-Bot team. However, a subscription can be discontinued at any time and will not incur any additional charges.  

Article 4 - Prices

Subscription prices are shown on the Site in euros, inclusive of all taxes. Prices do not include internet connection fees.and the Customer. The first month may be free or at a reduced price. In this case, it will be billed separately, then the normal rate will apply for the following months. In the case of a free trial, the customer may cancel the subscription at any time from "My space" and will not be billed once the trial period is over. In the case of a first month at a reduced rate, no additional payment will be required once the subscription has been cancelled. 

Article 5 - Ordering

To register and take out a subscription, the Customer must register and enter his personal billing information. He must also enter a valid TradingView ID so that his access to the strategy can be properly opened on TradingView.

Article 6 - Payment

Payment for training courses is made by credit card (or other payment options offered by Stripe) via Stripe's secure platform. The customer is redirected to the Stripe website at the time of payment. Trading-Bot.fr does not collect any payment information and does not handle payments directly, thus guaranteeing maximum security for the customer. 

Article 7 - Intellectual property

The training courses are the exclusive property of TradingBot.fr. The Customer is authorized to use the training courses for personal use only and may under no circumstances reproduce, distribute or communicate them to third parties.

Article 8 - Liability

TradingBot.fr cannot be held responsible for the use of the training courses by the Customer, nor for non-compliance with the regulatory and legislative provisions in force in the Customer's country.

Article 9 - Right of withdrawal

The Customer has a period of 14 days from the date of receipt of the order to exercise its right of withdrawal. Withdrawal means that the digital product has not been used. However, a tolerance will be applied on a case-by-case basis. 

Article 10 - Protection of personal data

TradingBot.fr undertakes to respect the provisions relating to the protection of personal data. The Customer's personal data is collected and processed in compliance with current regulations. Customers have the right to access, rectify, delete and oppose the processing of their personal data. Trading-Bot neither distributes nor sells any personal data, which remains strictly within the scope of the site's commercial operation.

Article 11 - Force majeure

TradingBot.fr cannot be held responsible for non-performance of its obligations in the event of force majeure, server or network problems beyond its control, or the unavailability of external sites (TradingView, WunderTrading, Bitget) required to use automated trading strategies. 

Article 12 - Completeness

Should any of the clauses of the present contract become null and void as a result of a change in legislation, regulations or a court ruling, this shall in no way affect the validity of and compliance with the present general terms and conditions of use.

Article 13 - Duration

The present terms and conditions apply for the duration of the online services offered by Trading-Bot.fr.

Article 14 - Evidence

The computerized registers, kept on the servers of Trading-Bot.fr or those of its hosts, will be considered as proof of communications, orders and payments between the parties.

Article 15 - Cookies

The Trading-Bot.fr website uses cookies. By using the site, customers acknowledge their agreement to the use of cookies. Only strictly necessary cookies are used on the site.

Article 16.1 - Trading risks

Trading involves significant inherent risks and can result in substantial financial losses. The Customer acknowledges and understands that he alone is responsible for the trading decisions he makes, and that he alone assumes the financial risks associated with these decisions.

Article 16.2 - Recommendations

TradingBot.fr advises the Customer to be extremely vigilant about trading, before starting to trade, and never to invest more money than he can afford to lose. Trading-Bot.fr cannot be held responsible for the way in which its information content is used. TradingBot.fr recommends that customers begin trading with demo modes and then with small amounts of real money, and that they do not overexpose themselves to risk until they are certain of their profitability. 

Article 16.3 - Limitation of liability of TradingBot.fr

TradingBot.fr does not provide any financial advice and cannot be held responsible for any financial losses incurred by the Customer. The training offered on the Site does not constitute investment recommendations and should not be interpreted as such. The Customer acknowledges and understands that he/she is making an informed decision by using the training courses offered by TradingBot.fr and that he/she alone assumes the financial risks associated with this decision. The Customer acknowledges that financial markets can be volatile and that asset prices can fluctuate considerably. The Customer must be aware of this risk before trading on these markets.

Article 17 - Affiliation and sponsorship offers

TradingBot.fr offers its customers and influencers the opportunity to sign up for free to become affiliate prescribers, and to do so on a remunerated basis. The basic remuneration is in the form of a 10% commission on all payments made by referrals until the end of their subscription. Influencers, subject to acceptance of their specific application, can have this bonus increased with the payment of an additional fixed amount contractually defined for each new paying affiliate registration (please contact us).

Article 17.1 - Membership registration and operation

Each site user can fill in the registration form on the site's "Sponsorship" page to obtain their own affiliation link and open their own affiliate space. Once registered, a personalized affiliate link will be available in the "Referrals" area, along with real-time statistics on results, payments received or to come, etc. 

When a new user (new IP address) visits our site for the first time by following this personalized link, he/she is registered as the affiliate of the sponsor to whom the personalized link belongs. If the new user subscribes to a paid package within 90 days of this first visit, the affiliate will be eligible for the relevant bonuses and remunerations until the user unsubscribes ("Lifetime": For the lifetime of the subscription).

Article 17.2 - Type of membership and remuneration

Each site user can become an affiliate under the site's standard terms and conditions, and will earn 10% commission on all affiliate payments.

Influencers, subject to a specific contract and an established and validated community on social networks, may in special cases benefit from an additional bonus (either an additional amount on the paid registration of one of their referrals, or an additional percentage on monthly subscriptions, depending on the conditions in force at the time of the contract). This special status is not automatic and is based solely on a contractual agreement with our team. In this case, the conditions of the contractual agreement will apply.

Article 17.3 - Limits and duration

Trading-Bot reserves the right to modify or suspend affiliate income or offers, even if the company's policy is to make the system permanent. In this case, the duration of the affiliation offer is not guaranteed.

In the case of specific agreements with influencers, the moral contract entered into with them will apply, and the conditions of the contract will be guaranteed for a minimum of six months (even if the company's policy is, a priori, to perpetuate the system over time), except in the event of complete cancellation of the affiliate's account, which would entail payment of the balance due, followed by cessation of remuneration. These conditions are at the discretion of the Trading-Bot team, and may apply in the event of deception, defamation or the use of abusive sales arguments in their communications that could damage the general image of Trading-Bot. Generally speaking, we prefer a long-term association with our affiliates, for the mutual benefit of both parties. 

Article 17.4 - Payment of commissions to affiliates

Commission payments are made only via a PayPal payment address. Affiliates are required to enter a valid PayPal payment address when registering, or to keep it up to date in their affiliate area. If the Affiliate does not have a PayPal account, Paypal will offer to open an account for the first commission payment. 

Commission payments will be made on the 1st of each month (in the event of force majeure, payments may be delayed by a few days at most). if the minimum commission of €15 is met. Otherwise, commissions will continue to accrue and will be paid on the 1st of the following month if the minimum is reached, or will be deferred for as long as necessary. 

Payments may be made with shorter lead times and lower minimum amounts than advertised which in this case will always be in the affiliate's favor. 

Newly earned commissions will be "frozen" for a period of 14 days, which corresponds to the possible withdrawal or refund period for our customers. In the event of an effective refund of a subscription, commissions earned on the refund amount will not be counted and will be deducted from the affiliate's balance. 

Affiliates can transparently monitor the results of their advertising campaign in real time in the dedicated affiliate area. They can track the progress of their commissions, pending payments and payments made.

Trading-Bot cannot be held responsible for an invalid PayPal payment address, and it is the affiliate's responsibility to ensure its accuracy. 

Article 18 - Modification of the GCS

TradingBot.fr reserves the right to modify the GTC at any time. The modified GTC will be applicable to new orders from the date of their publication on the Site.

Article 19 - Applicable law and jurisdiction

The GCS are governed by French law. In the event of litigation, the French courts of the department of the Trading-Bot company shall have exclusive jurisdiction.
